The operator and the owner of an operation are jointly and individually responsible for developing a written Ag. E&S plan, implementing and maintaining Best management practices, including ones mentioned in the Ag. E&S Plan.
The District administers the Act 38 Nutrient Management Program for Mifflin County. For more information, visit the Nutrient Management Page of this website. Concentrated Animal Operations are required to have an ACT 38 Nutrient Management Plan developed for their operation. This Nutrient Management Plan must be developed by a certified Nutrient Management Planner. A CAO MAY be required to develop an Odor Management Plan. The Pennsylvania Act 38 program regulates all high-density livestock and poultry operations within the Commonwealth. These regulated operations are designated Concentrated Animal Operations (CAO). A CAO is defined as an agricultural operation that meets both of the following criteria: 1) the animal density of all livestock and poultry on the farm exceeds two (2.00) animal equivalent units (AEUs) per acre suitable for manure application, and 2) contains eight (8.00) or more animal equivalent units (AEUs). An AEU is 1,000 pounds of live weight of any animal on an annualized basis, regardless of the actual number of individual animals on the operation.
The PA Manure Management Manual is currently under revision. It is expected to be released in the summer of 2011. Upon its release, a compliance flow chart will be place here. Until then, please contact the MCCD with questions.
